These Terms of Service (“Terms”) govern your access to and use of SCADA Miner (“SCADA Miner”, “we”, “us”), including the website, chat product, and MCP connector at chat.scadaminer.com (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
SCADA Miner answers natural-language questions about Australia's National Electricity Market (NEM) using publicly available AEMO market data. It generates and runs read-only queries against a data warehouse and returns answers, tables, and charts. The Service is provided for informational and analytical purposes.
Accounts
You must sign in to use authenticated features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. You must be at least 18 years old to use the Service.
Acceptable use
You agree not to:
- use the Service in violation of any law or regulation;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- interfere with, disrupt, or overload the Service or its infrastructure;
- circumvent rate limits, usage metering, quotas, or access controls;
- resell, sublicense, or commercially exploit the Service except as expressly permitted;
- use automated means to extract data beyond the provided tools and documented interfaces.
Plans, credits, and billing
Some features require a paid plan or credits. Pricing and included usage are described at sign-up or in the app. Payments are processed by our payment provider (Stripe). Subscriptions renew until cancelled, and fees are non-refundable except where required by law. We may change pricing prospectively with notice.
Data accuracy and no professional advice
Market data originates from AEMO and may be incomplete, delayed, revised, or subject to caveats. Answers are generated by automated systems and may contain errors. The Service does not provide trading, financial, investment, legal, or other professional advice. You are solely responsible for any decisions you make based on the Service, and you should independently verify any figure before relying on it.
Intellectual property
The Service, including its software, design, and content (excluding the underlying public AEMO data), is owned by SCADA Miner and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. You retain ownership of the questions and content you submit; you grant us the rights needed to operate and provide the Service.
Third-party services
The Service relies on third parties (including authentication, payment processing, AI model providers, and hosting). Your use of the Service may be subject to their terms, and we are not responsible for third-party services. See our Privacy Policy for how data is handled.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
Limitation of liability
To the maximum extent permitted by law, SCADA Miner and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the three months preceding the claim or AUD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Suspension and termination
We may suspend or terminate your access at any time if you breach these Terms or to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and continued use of the Service after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-laws principles. Courts located in Australia will have jurisdiction over any disputes, subject to any mandatory consumer protections in your place of residence.
